Alright well my boyfriend crashed the front of his truck into a tree last week because he slid on ice. He got a ticket from the Cops that day because he was "not handeling the car right" (because his car slid on ice and hit the tree). He is going to Court and pleading not guily with reason. He has a Bussiness (which is his lawn company). Do you think the judge will give him a check for a new truck just because he owns a bussiness? How long do you think the judge will take away his licence for? Just courious, Thanks.

I'm guessing he was cited for "too fast for conditions" or something to that fact. When he goes to court, he'll most likely pay a fine and receive points on his license. Whether his license is suspended or not depends on how many points he has.

The LAW is clear on this when it is an act of nature. When conditions exist that are un controlable, such as floods, huricanes, natural disasters, as long as you did not disobey an order not to venture out and it was an UNAVOIDABLE! out of your hands accident, then all he need do is plead NOT Guilty, Special circumstances. The Judge will reset the case and supeona the officer into Court. IF, the officer doesn't show, you win the case. IF, he does show, then the burden of proof is on him to prove that you could have avoided the accident and, that your negligence contributed to the accident. Not an easy thing for him to do since HE WASN"T THERE!!. I would definetly fight and go to trial by 3rd. party as a bench trial will always wind up with the Judge finding in favor of the officer.

He wont get a check from the judge, maybe a check from an insurance company to cover some damages, and more than likely his license wont be taken away only a few points put on unless he already has quite a few points, then it could be taken away.

I dont think the judge will give him a check and i dont think he will get his licence took from him also if the judge does diside to take them he should tell the judge that is his lively hood and the judge will probely let him drive only for work

did he have insurance? he will have to pay a fine not sure about the rest
