I turned 24 in June of 2006. My parents paid for 6 months of school (full time) and in turn I ended up graduating in June as well. I started a new job that same month and in September I moved out to the guest house that we have in the backyard. I meet 4.5 of the criteria that seems to be listed, but since I turned 24 in June of 2006, am I no longer able to be claimed as a dependent? (I made over 20,000 in the time I started a new job in June)

I might add that they would still prefer to claim me, but have zero interest in breaking the law

No, you can't be claimed as a dependent, since you don't meet the age test - have to meet ALL of the tests for your parents to claim you. It would be a good idea to mention this to your parents, in case they don't know it and are planning to claim you.

They can't claim you as a qualifying relative either, due to your income being over $3300.

So for 2006 you'll claim yourself on your return - you will NOT check the box saying you can be claimed as a dependent.

Since you were 24 or older at the end of 2006 and had more than $3,300 in gross income, you can no longer be claimed as a dependent by your parents. Where you lived or whether you went to school or who paid for it are not factors.

Your parents still qualify to take you as a dependent if they paid 50% or more of your living expenses for the year, and you were under 25 at the end of the year, and you were a full time student for at least 6 months of the year.

I would claim myself! Just tell your parents not to claim you as a dependent, it sounds like you supported yourself for the majority of the year and you deserve your refund!
