by Jan 31st you have not received your W2, call the employer and ask them if they have been sent. If by Feb 15th you have not received it, call the Internal Revenue Service at 1-800-829-1040 and file a W2 complaint. They wil take a report and send you a form that you can use as a subsitute, you will need your last paycheck stub when you call, along with the name, address and phone# of the employer and what dates you worked for them

Contact the emlpoyer first to find out where your W2 is first. If you don't get one, they can reprint it and send it out to you. But if they refuse to reprint it or say they're not issuing you one you can contact the IRS, http://www.irs.gov and your state's dept. of consumer and industry services. Many employers think the W2 needs to be posted Jan. 31 and not before so it may still be in the mail.

Contact the IRS and request a copy of your W-2. If they do not have one on file, this will notifiy the IRS that the company did not report earnes. This will provide you with the evidence needed to support any errors in your tax return filing.
