My friend was rape.d and her b/f and I have talked with her about turning the two guys in. She says that she won't do anything b/c she gave up fighting back when she knew it was hopeless and in the eyes of the law, that makes it legal.
Is she right??
The second reason why not is b/c the two guys were old friends of hers. She tried to fight back but ended up with a broken wrist and broken ribs.
If she was to report it what would it be considered?? Gang rap. or date rap.??

Your friend is wrong-there is no requirement in the law (US) that a woman can only be raped if she is fighting back. As to what the actual charge would be that would depend on what State you live in. If your friend was raped, she should seek medical treatment for her injuries (and to collect evidence should she decide to pursue this in the future) and also call the local rape crisis counseling center or women's shelter. They can better advise her about pressing charges, should she choose to do that (and its her choice) and can also assist her in obtaining counseling or a restraining order.

Rape is rape. Not fighting back for fearing for your life doesn't make it "legal". The wrist & ribs I am presuming she went to the hospital? So there would be record of that. Gang rape (it was more than one); assault (injuries); even possibility of detaining without consent. Go with her to a rape counselor (the police even have a section for that); do it now before any more time elapses. If she has visible injuries (bruises, etc) take pictures too.

In over 30 years in law enforcement, each and every victim of this nature has thought of a reason NOT to press charges!
First...the fight is NOT hopeless and obviously she has her facts about the judicial process mixed up!
Second...."Old friends???"....I'd say if someone committed such a tragic offense of Rape and Assault...they were NOT friends..old or new!!!
Your friend has a very good thing going for her....you! Be her support and tell her the importance of stopping these thugs from ever committing such a violent offense against her or anyone else again!
There are NUMEROUS support agencies available to your friend that will help walk her through this process. Most of those agencies can be contacted throught the District Attorney's Office, Crime Victims Division!
Please contact them immediately for more assistance!

Rape is rape. She should report it. She obviously tried to fight them off. The proof is her broken ribs and wrist. These 2 guys will rape again.. maybe next time just a kid.

Okay. First the law states that you have 24 hours to report it before you cant do anything about it. And Second. You have to go to a hospital and they take care of it. It is called Rape- 2 degree. 2 suspects. I am a police officer and this happens alot. If she is scared she can get a restring order.
