Does the 1099 have the same rules as a W-2 that you have to have it at least post dated by the end of January? What can we do to get this as soon as possible? I'd really like to file my taxes but I don't want to get rude or anything how should we handle this?

It has to be in the mail by 1/31. The law doesn't say that it must be postmarked by 1/31, only deposited in the mail or given to the employee. You still have a couple of days for delivery time.

If it's not forthcoming later this week, contact they payer and let them know you haven't received it yet. If you don't get it by 2/15, call the IRS. They'll investigate the matter; it usually only takes one call from the IRS to motivate people.

Assuming you mean Form 1099-Misc...

The employer has until 01/31/xx to provide it to the workers, similar to the W-2 deadline.

If it was sent in the mail, it could take a couple of days.

If it doesn't arrive by, say, mid-Feb., your husband could always ask his boss for a copy of his Form 1099-Misc.

FYI...
Your husband should have been tracking the income from the first check so he wouldn't necessary depend on that form.

Basically, the form helps the person confirm the amount of compensation he received during the tax year involved. Any discrepancies would then be found out if the amount reported does not match to the amount received.

You should get the 1099 right away, my husband makes good money but we always get hit with 2,000 to 3,000 dollars in taxes we have to pay due to the 1099. If you get it now you can start paying it off rather then waiting. My husband's ex boss did that and didn't give it to him until like April, ugh.. it was a pain, so get it now.

My understanding with 1099s is that the employer can file an extension (30 days) past the deadline to get it out to you.
