Never married the mother, has been able to see the child when wanted, but lately things have become more difficult? How does the father take steps to have rights?

All fathers have rights. The best way although expensive is to contact a lawyer. You possibly could get a free consultation somewhere. Do not, I repeat do not say anything negative in front of your daughter. Just because you and the mom are having a difficult realtionship does not mean you subject your daughter to it. Or you can go to your local clerks office online and print out the forms you need. which I am not exactly what ones they are given your particular case. The best would be to get a consultation and then decide from there.

We went through this when my husband's ex girlfriend started getting crappy about visitation with their daughter. We hired an attorney. She found out and sued for full custody. We countersued for full custody also. They ended up settling in mediation with their attorneys and now have joint custody. Her mother has primary physical custody (meaning that she lives with her mother and comes to our house every other weekend and holidays, also 5 weeks out of the summer). My husband now has court ordered visitation with his daughter. If she fails to let him see her, she is in contempt of court and could (however unlikely) go to jail. Child support was also set. He'd been paying her, and it just went up a little. It's expensive, but definitely worth it in the long run. She'll never be able to keep the child from you again if you're granted visitation. Good luck.

If you want to see your child you should hire a lawyer and get court ordered visitation. That will make everything alot clearer.
