what if i dont have his id or social security can i use mine and its going to be a seperate not jointly...

i know his social security its just that when he got arrested he lost his wallet no one knows where its at...i know the number by memory and its on his w2

If you file separately, be prepared to pay much higher taxes. However even to file a separate return you will need his SSN on your return.

His return can't be filed without his SSN either.

The IRS will reject any return with missing SSNs and assess a $50 penalty for attempting to file a return without one.

Addendum: You don't need his wallet to file a tax return. As long as you have his name, SSN, and W2s, you're pretty much good to go.
