Your car is clean inside. You haven't been drinking or anything else and your not acting suspicious. After getting your info the cop asks if he can search your car. If you say no what can he do? I know about probable cause but in this case there is none so I don't see why you should let them.

Choice A...say NO... If the cop thinks you were speeding because of some other crime, or he is suspicious for some other reason, he can hold you there for a search warrant. Or a drug sniffing dog. If the dog barks, the cop gets a warrant. Figure 2-3 hours of your life even if you are innocent of everything. They will search your car very closely if you make them get a warrant.

Choice B. say YES. Pop the trunk, open the doors, open the hood. Let the cop dig around for a while. Probably will take him 10 minutes. The fact that you let him search is a big indicator you have nothing to hide.

Of course, if you got drugs in the car, either choice is a LOSE LOSE situation.

Ask the officer what His P/C or R/S is, (Probable Cause or Reasonable Suspicion), Unless He's just being the typical stereotypeing officer, He should respect your right to refuse. Oh!,
Then comes the stereotypical reply, " if you don't have anything to hide, you don't have anything to worry about ". What about the fact that I have a Right to refuse simply because it belongs to me and I don't want you in it and I'm supposed to be considered INNOCENT UNTIL PROVEN GUILTY IN A COURT OF LAW ?????. Police today need to be put in check and some of they're 4th amendment rights VIOLATED!. you know a TASTE OF THE MEDICINE THEY DISH OUT!. As for what can He do?, He can put you through a waiting process and obtain a warrant OR leave you to your busuness. It appears to me that a person just excerciseing their Constitutional Rights have alot more to worry about than the Criminals they lose due to searching a Law Abideing Citizens Car.

Police do not have an automatic right to search your vehicle. Probable cause is necessary. However, if you consent to the search, no probable cause is needed.
What happens if you refuse? There are no legal repercussions, i.e., you can not be arrested for refusing. However, the officer can detain you for a reasonable amount of time to have the drug dog sniff your car (a dog sniffing your car is not a search). If the dog does not alert, the officer has no choice but to let you go.

What i would do is tell the cop that he obviously doesnt trust me and so for that reason you have probable cause to not trust him. Then I'd say I have no problem having my car searched just not by you and preferably a female cop. Alan

Unfortunately, the best option in this case would to just let him search the car. You could refuse but if you get a f'd up cop, he'll take you to jail and it'll turn into a huge problem for you. Who do you think they'll believe? The cop can always make something up and everyone is going to believe him/her. You'll have no chance..

Legally cops have no right to search your vehicle without probable cause.. The problem is that certain officers think they are above the law and cops ALWAYS stick together.. Even a good one will take the bad ones side before he takes yours... It's not worth the risk...

Always say no, no matter what. Cops have no legal right to search your car as long as you do not consent. Make it clear that you do not consent to any search. Say it out loud! "I do NOT consent to any search of my vehicle!"

Only bad things can happen to you if you voluntarily give up your right to be secure in your property. They are looking to 'get' you on something, anything.

At that point, it does not matter what you think, it matters what he wants from you. Comply so this cannot be interpreted as resisting. This is a smarter move on your part or it will give the officer reason to think you are hiding something. Also always be courteous to the officer.

**** no dude dont let a cop search your car they have no rights what so ever. trust me ive been pulled over a million and a half times
