I was making a left hand turn after making a stop at a stop sign across two lanes onto a road. I stopped looked and didnt see anything and thats all I remeber till later that night being in the hospital. The cops rulled me at fault, but the report has not been written, as far as i know the lady didnt try to stop at all and plowed me at 45! Will any blame be put on her for not paying attention? Am i screwed because i cant rember anything cuz she hit me so hard!

It a really bad intersection that I drive everyday, and I am always looking for cars. It was a gold car coming from where the sun was shining, and she didnt try to stop at all, no skid marks! The visability is exteremly bad. I am not a risky driver, so when her passangers claim was "it was a typical she was in a hurry and jumped out in front of us" It just doesnt seems right to me!

You are not screwed because you don't remember anything. You are screwed because when you pull your car into oncoming traffic you are totally at fault. Just like when you slam into the back of someone else's car. Doesn't matter if the lights are broken, it just matters that you hit them.

Don't get emotionally involved with what the other driver said about the accident. Tell your own company what you remember and let them handle it. Driver's are advised by their insurance companies to always avoid admitting any fault, it's just the way the game is played in insurance. I was hit by a guy running a red light and I could not believe he didn't say he was sorry, while I was having to go through physical therapy. After I was hit a second time by someone distracted by their slurpee (rear-ended) and then hit a third time by a man in an intersection trying to turn while holding a large cup of hot coffee, I gave up thinking anyone would ever just say "I was driving like a total jackass and I apologize". Just not going to happen.

I think the cops said you were at fault because she was able to tell her side of the story, and you were unconscious. If you can't remember what happened when the cars collided that could be bad, because they may assume you weren't watching where you were going, or didn't look for oncoming traffic before you turned. Also people turning usually have to yield to people not turning, so that could be another reason they think you were at fault. If it was a four way stop the other person is definitely at fault, because there is no way they could hit you at high speed unless they blew the stop sign. If she hit you at really high speed she probably wasn't watching where she was going, and never even tried to slow or stop. You should get a lawyer and you may be able at least get some insurance money for your damages.

Most likely, you are 100% at fault. The lady was travelling through an intersection where she had no duty to yield to other traffic- why would she expect someone to cut in front of her? Yes, it sucks to admit fault... its not like you got hit on purpose.. but you need to understand that you are admitting yourself that sunlight was blocking your vision and you cant even stick up for yourself about what actually happened since you dont remember. You failed to yield right of way- its your fault. There is NO WAY to prove to other driver was speeding.. plus everyone always blames that the other person "must have been speeding- they came out of nowhere!!!" At the most... in extreme cases.. a slight negligence might be put on her if she admits to seeing you and not braking (which she wont) or if she hit the very very rear of your car or something and could have had time to avoid... but please dont count on it.

And I assume the other road you were turning left on to did not have a stop sign or you would have mentioned that. So you had the stop, but then turned in front of an oncoming car.

I'm sorry about your injuries, but based on that, yes, you are at fault. You remember nothing, yet assume she didn't try to stop at all. For all you know she had her brakes locked up trying. You don't expect people to pull in front of you when you have the right of way.

If I were your insurance adjuster, YES I'd find fault with the other driver. All drivers, like it or not, have to the same duties: duty to avoid, duty to keep proper lookout, duty to reduce speed, DUTY TO PAY ATTENTION.

However, there's more to your story than what you've written...at least scene wise. As such, there are many other factors to consider. Blind corners/turns, obstructions....that sort of thing.

You will likely take the blame, unless she was speeding/hit you in the rear quarter of your car. Some states have a sort of 'no fault' law if you're hit from the rear. Check with your agent.
