My son was a passenger in a boat and died. The operator walked away and never even called 911. Not only did my son die, another passenger died as well. The operator is enjoying his life while my life ended on that horrible day.

It depends on the facts of the accident. Legally was this person negligent or violating a law with his actions> If you believe so contact your District Attorney. Also It is possible to sue for wrongful death in a civil court without a state charge.

I'm not trying to say that you are trying to gain monetarily from the death of your son. But if you are trying to make this person pay somehow or make a personal statement this may be a course of action.

First I am so sorry. Only a person who has lost a child can fully understand the significance of such a loss. I am sorry.

Unless the operator of the boat was operating it in a reckless fashion, ie. intoxication, recklessness, etc., there is little law enforcement can do.

You didn't tell us what caused the death of your son. Did he fall out? Did he drown? What happened? Did he hit a rock? Another boat?

Accidents do happen. If it was simply determined to be an accident, there's no criminal charge to be filed.

There's nothing anybody can say or do that will restore your son. You need to keep in mind that your son would not want your life to be destroyed as a result of the loss of his life. It's easy for me to say because I am not in your shoes but you must move on with your life.

Do seek counseling. Talking these things out with a professional might help you get your life back on track. Good luck.

Your question says nothing about how your son or the other passenger died. That is the most important information to answer your question. As far as I can tell from what you said, you son could have died of a heart attack. If they were already dead by the time 911 could have been called, there would be no reason to call.
Your life was changed forever on that day but it DID NOT end.

They are in a lot of states... here a boat operator can be charged with DUI, vehicular manslaughter, etc if operating a craft improperly.

If you can prove there was negligence there willl be responsibility. However, he needs to have done something wrong besides just survive.
