Doesn't that gesture mean that I intend to rape you, or at the very least wish rape upon you? It it a thought or a threat? Is there a difference?

The f word refers to sexual acts in a violent context. How is that not rape?

No. If the police came unto the scene, and she said you gave her the finger, but you said you didn't, they couldn't believe just her. Its he said, she said. Its just an obscene gesture that just means you dislike said person.

While the letters in the "F" word do technically stand for

which basically means rape that is not how the gesture is intended in today's "language" it is usually a way of expressing how one feels about another in a negative context with out having to actually verbalize it.

That is an urban legend... not true... it's been shown to be in your first amendment rights.
Of course if someone gives you a good old fashioned beat down for it, I would have to laugh, but then again, you asked for it right?

The meaning is just "up yours," and it is generally assumed to be an expression of anger or frustration, not a threatening action.

no. its an expression, and falls under freedom a speach, but if you say in a threating manner that you are going to do bodly harm to them and they are in fear for their life, then you could get in trouble
