If the father disappers from the child's life, is it possible to change the baby's last name back to the mothers or do you have to have his consent?

talk to your local social security administraion office. they can tell you all the details of when you can and cannot change someone's name. my guess is if you really are adamant about it, it can be done. i've changed my name three times now (married, then divorced) and will be getting it changed again (new marriage) soon, and each time, the office has been able to answer all of my questions. they are the experts, after all :)

If you have full legal custody, it should just be an issue of changing the name legally (might cost you a hundred bucks or so for the registration fees and whatnot. I'm not sure.)

But make sure he's truly gone--make efforts to contact him and all that from a legal standpoint. You don't want it to look like you're trying to kidnap the baby or something (custody battles can get super-ugly and you don't want to give the guy any ammunition.) That's regardless of the name change--that's just to cover yourself and the baby's legal issues.

Yeah, I'm pretty sure you will have to get his consent. At least if he is named as a parent on the birth cert. and especially if he has any custody "rights" still. I'm looking at the same thing. I'm getting ready to have baby #2, and headed for divorce, but even though i plan on changing my name back asap, I don't think i have a choice as to his/her last name yet, so that will be 3 name changes I will have to pay for later. BUMMER!

Ok let's sart with what your not telling us-Is tis man on the certificate or does he just have his last name? Around here name changes go through The Health department's birth records department. Goodluck

Yes; many people change their last names and some - full identity. Of course, you'd have to go through a legal process to change names.

If his name is on the birth certificate then no you can't just up and change it. Why change it? Who cares if he is not around anymore. That is what your child is (whatever the fathers last name is)
Do you want to try to change his last name to yours and then later on in life he might end up with someone kin to him because he will be thinking he is not kin because of the last name.

If the baby is less than one year old, you can change their name to anything you want to. After one year of age, you must submit an application to the court to change it legally.

you have to go to court and request the name being removed.... it may take some convincing but it can be done. you will have to prove that it is in the best interest of the child for instance..all his sisters and brothers have my name and he has his fathers so he feels like he doesnt belong in the family and is an outcast.
