My elderly mother lives in an assisted living apartment complex. She is under the impression she can get a tax break for the monthly rental charges she pays.

No for federal. Many states have a rent rebate program that provides a partial rebate of rent. It's often limited by the age and by the income of the renter. If you post what state your mother lives in, you might get a more complete answer on their program. Or check the state website.

Part of the cost may be deductible. The portion of the cost that covers actual medical care and nursing services is deductible as a medical expense on Schedule A. Medical deductions are subject to a 7.5% of AGI limitation.

The portion of the charges that are purely classified as rent is not deductible.

She needs to call the IRS tax law line: 1-800-829-1040. If she feels better about you calling, be sure to make the call with her in the room in case they need to look up her account. That way she can go through "disclosure" a legal interview IRS goes through to verify the identity of the person, then your Mom can give IRS permission to speak to you about her account.
