Arn't they all supposed to be out by January 31st? Can they be fined for that or something?

Employers are required to have W2s IN THE MAIL by January 31st. You must still allow time for the Postal Service to get them to you. That can take up to a week though usually it's a bit quicker than that. If you don't have them by next Tues or Wed, call your employer and ask if they've been sent out.

If your employer is giving you a runaround or hasn't sent them by Feb 15th, you can call the IRS. The IRS will investigate. Most times all it takes is one call from the IRS to get a lazy employer off their backsides and get the W2s in the mail.

If employers don't get them in the mail by 1/31, they may be subject to a penalty of $50.00 per W2 that is late if they don't show good reason for being late. If they willfully disregard the rules they can be penalized an additional $100.00 per W2 that is late.

by Jan 31st you have not received your W2, call the employer and ask them if they have been sent. If by Feb 15th you have not received it, call the Internal Revenue Service at 1-800-829-1040 and file a W2 complaint. They wil take a report and send you a form that you can use as a subsitute, you will need your last paycheck stub when you call, along with the name, address and phone# of the employer and what dates you worked for them

W-2's and 1099's must be "delivered" by January 31st. "Delivered" means physically handing them to you or putting them in the mail. I just got my 1099-G yesterday and it was legally on time. If it has not arrived in a day or two, ask why not.
