They are not permitted to KNOWINGLY sell expired, dangerous, drug-laced or tainted food, due to pure food laws established and enforced by the FDA and the USDA. Rules and laws govern the quality, grade and content of all food sold in the US.

If they knowingly sell bad or tainted food, yes, they are breaking laws (the laws broken and what they are charged with will vary, depending on what was sold, how much was sold, how tainted the food was, if anyone got sick, etc), but they are minor, usually just a fine is imposed, and you have to prove they did it knowingly.

If they sold you moldy strawberries or a similar item in small quantities, and they did not know---or could not reasonably know--- they were moldy at the time, your recourse is limited: take them back with your receipt and show them and ask for new ones, immediately. Ask them to check their stock, to make sure no more are moldy.

If they knew, or had reason or opportunity to know, that they had e. choli- infected or mad cow- infected beef and sold it, or sold other food they knew to be bad or dangerous to others, they are in for a world of trouble, and they deserve it. Report them to one of several places:

the USDA
