We haved lived together all 2005 and 2006, at the end of 05 he had lost most of his vision and was deemed legally blind. His income SSI and my income combined is about 20,000 for the year.Most of my income is a 10-99. I was told I could claim him as a dependant , can I & how?

This is from 2006, so it may have changed slightly, but you CAN claim a non-relative as a dependent as long as he meets ALL of the requirements. If his SSI is not taxable, you stand a good chance. Check out this publication:

Is your income more than his SSI and Medicaid benefits? If so, then you can probably claim him as a dependent, since it is likely that you can establish that you paid more than half of his support.

From your information, it appears that you would not benefit significantly from claiming another dependent. You cannot take anything other than a $3,300 dependency exemption for him. You are not going to get any benefit from his disability.

If he lived with you all year and you provided more than half of his support, then you can claim him as a dependent. You can't file as head of household though, would still have to file as single.

His being legally blind doesn't affect the taxes.

You claim him on the form 1040 in the dependent section.You may see if you can file as Married filing jointly (you may be considered married for tax filing purposes). If so, you list him as being blind and get a higher standard deduction. I would recommend having your taxes prepared for you. The IRS will prepare them for you for free if you like. Contact the irs at 800-829-1040 for the nearest office. Good luck.
