Sexual Harassment is defined so broadly these days that this episode can certainly be defined as such. Sexual harassment includes unwanted physical contact, advances, crude jokes & language.
Some people, unfortunately, define it as "anything that someone does that makes me feel uncomfortable." This definition is troublesome because it does not account for the intention of the "perpertrator," only the feelings of the "victim." It is therefore very easy to accuse someone of sexual harassment, and almost impossible for those accused to defend themselves.
What Justin did was juvenile, that's for sure. If you complain about his behavior, will you get in trouble. Is Justin in a position of power over you? I ask because some say it can't be called "sexual harassment" unless you're being harassed -- bothered in a way that you can't say NO or complain about it.
If Justin were a boss or a teacher or in some position of power over you, then it would be harassment.
Should Justin be suspended or expelled for what he did?
Some would say that what justin did isn't really harassment, but just very annoying. You CAN probably put a stop to it effectively by telling him to got to hell.

Yes, of course it is; it's also battery, but are you asking in terms of legal prosecution? If so, grow up.
You didn't say how old you were, but if it's middle or high-school, you would definitely do this guy a favor if you reported him to school authorities (teacher, principal---believe me they are required by law to take this very seriously), in terms of stopping this "bad habit" now. You will help to keep him out of serious trouble later. He needs to learn now that unwanted touching of any kind is a serious offense.
I don't think it is helpful to any women for this kind of minor harassment to be reported to the police, etc. because it does a huge disservice to the women who are truly assaulted (by strangers, or involoving violence, etc.) This guy was probably just flirting with you (although in a coarse and immature way) but he needs to learn NOW that this is both coarse and immature, (as well as illegal!).
If you want to be kind and if you have the courage, your best course of action might be to give him a firm (but friendly warning): "I know it was probably the highlight of your day, but if you ever touch my butt again, I will report it."
Do not engage in conversation, do not have any back-and-forth about it. Just practice saying that in the mirror, and when you get the right tone, say it to his face, privately, and with good eye contact. You will be doing him a big favor.

It can be but the age of both of you have to be considered. Young boys often do such things but are not meaning to harm you at all. It is part of the process of learning. Young girls tend to get much too searious aobut such things. When you see him again tell him that if he does anything like that again you will bust his nose.

even as the harassment turns into sexual, that is sexual harassment. Touching, innuendo, gestures, puppy names, seems, etc... you may truly tell even as someone is laying aside a violent vibe as against a sexual vibe, or maybe as they're putting out both.
