will their insurance company pay for their car to get fixed ( the person who was drunk) I think im correct in saying no..but can someone with experience or knowledge about this give me some input

from what i understand..she hit a car almost head on, so the police obviously came and thats when they did the sobriety test and she failed...they took her to the holding center and let her go the same night..so the police already know and have given her an appearance ticket for court...so the insurance co will def. know she was intoxicated when she got in the accident..i dont know how much alcohol she had tho..but here in NY state the limit is.08

I can see that this question will get answers from all over the board. I am an insurance adjuster with an insurance company that sells automobile insurance only. So to answer your question, if the registered owner was the driver at the time of the accident, he/she is not going to be covered if they were drunk. But what is drunk? Did they fail a sobriety test by miles and miles, or were they just there on the edge. If they were borderline it might take the outcome of the court case to decide the outcome. If they were falling down drunk it's a slam dunk.
Next, if they were not the driver were they in the vehicle at the time and did they give the driver the keys and permission to drive? If you said yes, bad answer, they just got denied again.
Finally, did they lend their car to someone and had no knowledge of the drinking and driving infraction until the police showed up and advised them of what happened? Best case scenario, the registered owner is not a party to the breach, will get paid (but don't expect a quick settlement) and the insurance company is going to sue the driver to recover all costs.

The insurance company has an obligation to pay for damages. The insurance company will either drop the insured after they pay or the insurance will be extremely high as the person will be considered a high risk driver. The insurance company has also an obligation to report the drunk driver to the state department of motor vehicles office and they will more than likely suspend the license of the offender. Either way the driver is going to pay for his bad choice dearly. If the insurance company cancels the policy it may be difficult to get any other insurance company to grant a policy to this driver as records are reported and easily accessed pertaining to the drunk driver.

Both are at fault. The person who hit him is at fault for causing the crash, the drunk driver would also be charged with drunk driving. This kind of thing actually happens quite often. A cop stops someone for something totally unrelated and simple, he has a tail light out, he has a turn signal out, his plates are expired, or as you said he was involved in a wreck that clearly wasnt his fault. Upon the officer questioning the person he spots that they are drunk-of course the person is going to get ticketed and charged with DUI for this.

Usually insurance policies have clauses voiding coverage if the accident occurs while a crime is being committed. Drunken driving is a crime. If one has had an accident while drunk, the car repairs are probably the least of his/her worries. In Manitoba, if you are permanently disabled from an accident while driving drunk, you will not get any income replacement benefits for the 1st year.

it depends on the coverage of the vehicle. If it carries collision then yes it will. The same case applies if your car got stolen and got involved in an accident. If you have comp then your insurance will pay for your claim but not the other property damaged.

yes for sure if you are doing some thing illegal and any one gets hurt it is your fault or property gets damaged , that accident should have never happend cause the driver who is intoxicated should have not have even been there in the first place insurance companys verry see the policy for more info i would think if the driver was not the owner and the owner had insurance it would be coverd

depending on the type of coverage that the drunk driver had; they may pay for what happened and then drop him/her from the policy, or chose not to pay nothing at all. It all depends on the type of insurance and what the insurance claims that it will fix and not fix.

If you have full coverage the insurance company will fix your car. Your rates will go up or they may even drop you all togather. In my state you will lose your driver's license for awhile.

Probably every insurance company is different but USAA pays for both cars to be repaired however your premiums would probably go up quite a bit

the insurance usualy covers the cost but i think if they got cited for a DWI or DUI or what ever they call in where u are from the driver's license gets suspended and they will drop his or her insurance policy becuase they dont have a license
