The tomato is the end product of a fertilised flower so it is a fruit. Vegetables are either leaves eg. lettuce, roots or tubers eg carrots and potatoes or stems think celery. As stated by other respondents the fruit of a plant contains the seeds.

Tomatoes are fruit.
I've heard something about seeds before, but it doesn't make sense in the other answers, or cucumbers, peppers, squash, corn, peas, beans, etc would all be "fruit", too, by their definition.
