My friend mother has custody of her two girls.The mother has stayed with my friend for the last three yrs.About 3 days ago my friend filed her taxes and was told the next day to come back in because someone has already claimed the girls.(It was her mom).So my question is who has the right to claim the girls my friend because or her mom?Don't forget the mom resides with her although she has custody of the girls.

but i will tell you what the IRS told me when my piece of s223 ex wife let some guy do it, no one can give anyone permission to file. She as her mom can file and make the other person pay back the taxes and get in a load of sh##$

if your friend's mother has legal custody of her grandchildren she has the right to claim them on her taxes. i suggest your" friend" gets her life together before she starts worrying a/b who has a right to claim them b/c her mother wouldn't have custody if there wasn't a good reason now would she? the grandmother is the one providing for them not the mother. when you are a loving parent and care giver that's when you are entitled to those benefits. being a parent is a constant job,not when it's convient for you. like tax time. be a friend and help her get it together. take care

I believe it would be the grandmother simply because she has legal custody. The kids are in her care regardless of where she lives. It is her sole responsibility as legal guardian to care for them whether or not the mother takes part. Sorry : (

The parents claim their children. The only way to legally claim the children is to get permission from the parent of the children.
