ok, the guy i was dating wanted me to buy a computer from him for 75$ (i didnt have one at the time but used the ones at work a lot) i wrote him the check and he loaded it up into my backseat for me. i drove 2 hrs home and when i got there and started unloading it guess what, no tower. i called him and asked him why and he said "i know i accidentally put it in the wrong vehicle"and said he would bring it to me in a few days. 2 weeks went by and i still didnt have it. i cancelled the check and didnt tell him because i thought if he still cases the check without giving me the tower then hes a real jerk. guess what, he called me up yelling at me because i stopped payment on the check and it costed him $500. then he started spreading lies about me and we never spoke again. i felt like he was insulting my intelligence but i feel guilty for some reason even though he got what what he deserved. who was right?

It sounds to me like you had an instinctive feel about this guy when you cancelled the check.

And not only is he a complete jerk, he's a liar too. There's no way you cancelling a check for $75 could cost him $500.

Consider it a lesson learned, and keep paying attention to your instincts!!

You presented your side of the story, and any person not driven by emotions should ask you a few questions:
- Since, as you wrote, the equipment was loaded on the back seat, how come you didn't notice the tower was not there when you got in your car?
One might understand you didn't notice the mouse, but the tower???
You might have solved the problem on the spot, but let's assume you trusted the guy; here are other questions:
- Don't you think a dishonest guy would have told you that he loaded everything?
- During the 2 weeks waiting period, did you call the guy more than once? What did he say?
- Do you think a dishonest guy would have let go more than 2 weeks to cash your check?
- You put a stop on the $75 check, but you don't mention what happened with the rest of equipment? Did you return it?
Depending on the age and the model, just the display, the keyboard, the mouse and eventually the speakers might be worth more than $75.
However you slice it, your story doesn't look 100% kosher...
Consequently, it's impossible to honestly tell who is right and who is wrong.

He was definitely in the wrong here - for not seeing that you got the tower you paid for in a timely manner. You shouldn't feel guilty (unless you did not return the other components to him?)

I don't know how he could possibly be out $500 over the stop-payment of a $75 check. He must be lying about that. You are much better off without this jerk, so don't worry what lies he is spreading about you...YOU know what really happened, and that's all that matters.

I can certainly understand you being upset and cancelling the check, but it would have been the right thing to tell him you were cancelling the check. He was defiantly in the wrong, but it is not right to seek vengeance and $500 is a lot of money. How can you fix the problem so that you can dump the guilt...I am not sure. I would start by giving him the other computer parts back or pay him for those parts. Then I would apologize but stand my ground that cashing the check was unacceptable since you still did not have the computer that you were promised. Do not argue or blame and if you feel that you cannot resist e mail him!

First of all, I love your screen name! :) Second, you are absolutely right. You did not get the product you paid for when promised, so you had every right to stop payment. I don't see how stopping payment on your $75 check could possibly cost him $500 unless he was writing hot checks. One bad check does not rack up that much in fees. $100 I could believe, but not $500.

Well...think of it this way...he sold you a useless computer...and in return he received a useless check...he deserved exactly what he received. I do think I would be proactive and have the useless parts of the computer that you did receive delivered back to him, by a company that can certify that he received it.....this way he can not take you to small claims court to get back at you. How do you accidentally put the tower in another vehicle????? And the whole $500.00 is a crock of BS. As far as the *rumors* he has spread around....if you hear about it threw the grapevine....tell it like it really is...sooner or later that vine will go right back to him, and in the process he will lose the trust in a bunch of people along that vine.

You were right, and I don't know how that cost him $500 when banks usually only charge a $10 returned check fee...unless he wrote a ton a little checks that bounce on that one.
You should take the stuff you did get back to him though since you technically haven't paid for it.

I find it unlikely that your stopping the check cost him $500, unless his bank charges huge fees for bounced checks, and he managed to write LOTS of checks somehow with your $75. I certainly think you were right to stop the check when you didn't get what you had paid for.

if you are worried about someone insulting your intelligence, maybe you should of done a grammar check before posting this.

Did you ever get the tower?

To answer your question, I think there was no right or wrong here. I think you should of told him that you wanted the tower before he cashed the check. If you didn't trust him, I would of stopped payment on the check AFTER telling him this. Then once you received the tower you could of wrote him another check.

I do give you props for writing a check instead of giving him cash. I feel bad for you though because I know even stopping payment on a check costs about $15 and you got nothing in return except, I am assuming, a monitor and a keyboard.

Good luck to you and you are correct, he is a jerk.

u were. you paid for something and he told you a shady answer trying to scam you. And there is NO WAY your cancelled check cost him 500 bucks. (20 maybe, but how on earth 500!) Anyways, dont beat yourself up. You did the right thing.
