I have problems defining my tax filing status. My wife and I got married in June of 2006. I worked all year in NYC and my wife till August in Boston. Even though I worked in NYC, my official residence was in Boston, MA till MArch. My wife lived till September in Boston before she moved to NYC. Do I file "married filing jointly"? We had different residences and it seem that the State filing requires us to file the State as "married filing seperat"? Can I in this case file as head of the household for MA since i financially supported the residence ?

Your only choices are Married Filing Jointly or Married Filing Separately. You can always file a joint return whether you live together or apart. If married you cannot file Single or HoH from the facts given.

For your state returns, you have the same option basically. Some states will allow a spouse who was not resident to exclude their income from taxation but will require the resident spouse to file MFS to do that. You should figure your tax both ways and go with whatever is best for you.

Some states require you to file the same as your Federal status. Since the Fed tax bite will almost always be the worst, the best way to file is usually MFS even if that means one spouse paying tax in a state that they didn't reside in.
