Don't fool around with the IRS. If you know that you are waiting on another W-2 - then you should not file until you receive it.

I think you could theoretically file your return now, but you would have to file an amended return before 4/16/07. Why raise suspicion with the IRS? (which could result in an audit)

Your W-2 should be in you mailbox in a few days. The deadline for employers to mail them out was January 31st.

Hang on until you get it.

It's not illegal (as in you won't go to jail for filing an incorrect tax return), but it will be in error. (happens all the time - but they always catch it eventually). And when the other W-2 comes through, most likely when you refigure with both together, you end up having to pay money to the IRS, since you received a larger refund than you deserved (based on a lower taxable income).

Ouch. Personally, I would avoid that. Wait for the other W-2, or use the info off your last paystub, and file correctly the frist time. Much less painful.

you must file an amended return using Form 1040X but must wait until Feb 15; there will be no penalties and nothing illegal but file before deadline April 16; if the IRS chased after everyone who intentionally and unintentionally did not file all their W-2s,they would have to let all of the pot smokers out of prison to make room for the tax "cheats"; now that would not be justice in America, the land of the free, would it?

Dude, wait for the other W-2. I had the same situation last year. The older job will submit the W-2 to IRS. You will have to file all the W-2s that you have. So please wait for the other W-2. If it's too late, call your old job or IRS. They will help you out. Good luck !

A friend of came over today and told me he filed his taxes last week, and yesterday got another W2 in the mail. He called the tax guy that did his taxes, and he is now being charged $150.00 fine because of it. You better wait.

Ask your tax preparer. If you let them know your are still waiting they can at least get the process started. You might have to file a second time if you try to proceed.

I have long championed both lower taxes and reform of the existing tax system, and recently signed the Americans for Tax Reform pledge to oppose all tax increases. Much of our recent economic prosperity is directly attributable to the lower taxes enacted by recent Congresses. I believe America’s tax code is overly complex and burdensome. Americans spend roughly $157 billion each year in tax preparation, to ensure they do not run afoul of the Internal Revenue Service. The system is desperately in need of reform. I support a flat tax concept that simplifies tax preparation, applies a low tax rate to all Americans, and respects the special financial burden carried by American families raising children.
