I was in a similar situation. Have your wife apply for an ITIN. Read all about it here: http://www.irs.gov/individuals/article/0,,id=96287,00.html#what

The application for ITIN simply gets attached to your tax return. You have to file a paper return to make it work right.

Im in the same situation. I am a legal resident and my wife is in the proccess of getting her green card. We got married one year ago and it takes a long time. This is the first time we will be doin a joined tax returned. She got her Tax ID or ITIN 4 years ago. I know that illigal immigrants are not supposed to work but if they do (babysitting or cleaning), they should reported it using a Tax ID. This is to prevent the illigal immigrant to get charge fine once she/he tries to get her legal status. Check with your immigration lawyer.

For the smart elics on here you cannot automatically legalize a person by marrying them. It takes a long time for their status to normalize...sometimes decades and sometimes never.

You may be able to get an ITIN for her. You need to consult with the IRS...do not worry the IRS and DHS are not in communication and they are not buddies.

I am surprise that you don't know that her legal status is that she is your wife. Once that can be proved, she can get her SSN and work just like the rest of us. Welcome to slavery in the USA.

I think we should all be able to claim them. We all pay for them. You have to share, in that regard.

You can't. You can either come clean and hope they don't deport her, or keep hiding.
