My ex has been in and out of jail, he has never done anything, pay child support, see her or anything. Is there any way I can have his parental rights terminated??? I do not want my daughter around him or his family, they are all in and out of jail for drugs. Could this be done in any way???

There is no easy way to do this (even with an abusive ex, an ex that has addiction problems, etc -- judges are VERY LIBERAL in retaining the "Father's" rights in the case of a child) ...

You really need to talk to a Family Law Attorney in your area. IF he is in jail (for several years, and IF it is for Possession/Intent to Distribute, or for distribution of Illegal Substances), then your attorney can present to HIS attorney/him at the jail the 'benefits' of relinquishing his parental rights -- and that can include the "offer" to him that he won't have to pay child support IF he now gives up his parental rights voluntarily.

OTHERWISE ... it could go either of two ways when it goes to court ... it could be that the judge looks at his criminal record (and his family's criminal record) and just denies him visitation/custody ... or ... it could end up being an UGLY and EXPENSIVE Legal Battle.

Now this all depends on how much you are willing to spend on the case, as well as how GOOD and VERIFIABLE your Records of his conduct and legal problems are ... and if you don't have much money in the 1st place (income is very limited), you COULD try Legal Aid where you live. Beware this is quite the 'last resort' and that a LOT of cases are NOT able to be helped through Legal Aid.

Consult with an attorney or social services. Parental rights can be terminated but it is a legal process.

You really need to speak with a professional about this. It is different in different states. Due to the circumstances I would think you can petition the court to sever his paternal rights but do check it out first.

contact legal aid. its free for low income people.get it back into court to present your case before a judge. he will have the final say so. but make sure you have a lot of good reasons why you want to do this, because judges tend to frown on it now days.
