my hasband made more than me this year. can he file head of household and claim me and our daughter as dependants? i would just file married filing w/ no dependants right? can we do that?

No, head of household is only for single people. If you are married, you must file as married, either jointly or separately. Jointly is usually the best, since you usually get the most out of your credits and deductions. Filing separately might be useful in the case of very high income for one, very low for the other.

You would be married filing jointly with your daughter as a dependant. Depending on how much the both of you made, you might also qualify for an earned income credit. Go to www.irs.gov , then go through the steps to file online. They'll redirect you to a free online filing program that will answer any questions you have and also help you file correctly.

Look in the Blue Pages of your phone book under US Government and look for the Internal Revenue Service Taxpayer Assistance Division office nearest to you. Bring ID ,Social Security cards for all on the return. These folks will not only answer all your questions,but fill out the forms,and file your taxes for you for free. Bring all paperwork,W-2's etc..

NO he cannot claim you and then you claim yourself. You and he can either file "married filing joint" or "married filing separate", but only one of you can claim your daughter.
