by Jan 31st you have not received your W2, call the employer and ask them if they have been sent. If by Feb 15th you have not received it, call the Internal Revenue Service at 1-800-829-1040 and file a W2 complaint. They wil take a report and send you a form that you can use as a subsitute, you will need your last paycheck stub when you call, along with the name, address and phone# of the employer and what dates you worked for them

They have to give them to your or place them in the mail by January 31st. The law does not provide for a January 31st postmark date, however. You should wait a week or so for delivery. If you don't have it in a week or so, your first contact should be your employer. They may be experiencing delays for reasons beyond their control and have received an extension of time to get them out. Or if may have been returned as undeliverable due to an address change or simply may be lost in the mail. Your employer can advise you and remedy these situations pretty quickly most of the time.

The IRS won't even take missing W2 and 1099 calls until 2/15 or so.

January 31st is the date that they should be in the mail to the employee. Theses forms are not due to the Social Security Administration until February 28th and the employer could get an extension of 2 and one-half months for filing them.
