My husband and I were seperated for some time and last year we got back together in April. I am filing my taxes but he is not, and wont let me have his income info so i can file at least seperately. I no longer can file head of household, at least i dont think so. We also have a minor child. How can i file my taxes without his w-2 info.

You can always file married filing separately if you have your own income. Go to http://www.irs.gov for official information. Never accept what you see here as fact. It is usually only opinion.

You can file Married Filing Separately if you husband refuses to file a joint return and turn over his information to you to prepare a joint return.

If you file MFS, the only thing that you need from your husband is his SSN. You don't need ANY of his financial information. Since he's hiding something from you, it's probably best to file a separate return; this will exempt you from any claims that the IRS could assert against you if you filed a joint return. It also isolates you from any crimminal prosecution for your hustand's actions.

If you have the higher Adjusted Gross Income you are entitled to the exemption for your child. If your husband doesn't file a tax return or if he files one and doesn't claim your child that will be a moot point, however so you'd get the exemption.

Contrary to what another poster stated, you CANNOT file Head of Household since you lived with your husband during the last half of 2006. To file HoH, you would have had to live apart for the ENTIRE last half of 2006 and that does not appear to be the case here.

Actually you have two problems here, one is your own filing status, and the other is the potential liability that the IRS may place upon you in the event your husband has income and fails to file. You definitely want to file "Married, Filing Separately!" If you have separation agreement, this might preclude future IRS liability for your husband's income, but you should check into this. You can always call the IRS and obtain an opinion, (800-829-1040). If your husband isn't filing, and you contribute to the support of your minor child, you would most likely still qualify as head of household. File as married, filing separately, and you don't need to have his income info. But be sure to investigate the long term liability of being with someone who won't be truthful with you. Good luck.

Married filing separately is WITHOUT his info,
you do NOT use his info / W2 to file seperate, that is what separate means . . .
Married " " , is just YOUR income and if he insists on filing separately, make sure you don't both try to claim the child / head of household because that becomes tax fraud.
Contact the IRS on the 800 # and ask about how to manage who is claiming head of household / child.

You file "married filing separately", and you claim the dependency exemption for your child.
