I been a single mother for three years, been living on my own with my daughter but her father also watches her when am at work. I am not married to him but he still tries to control my life , I am scared that he might take away the baby from me I want to file full custody so I can go home with my parents that r in a different state please help me

If you are not married and even if you are and there are no conditions "legally" set, then you can move to your parents with or without his knowledge. But I will advise that you need to check with an attorney as soon as possible to make sure all your bases are covered. But you can move, and then look for an attorney there. just move. there isn't anything he can do but take you to court for visitation and then more than likely he will have to come 1/2 way to meet you, to pick her up and then bring her back to the same place.
if there is no divorce decree than you don't have to answer to him or anyone else. if he is that controlling than it would be best for you to get away.
do not let him know you are moving until you are ready to drive out of town. send the baby ahead with the parents. because he might try to stop you by using the child.

p.s---i'm not saying never let him see the child, but after you are settled then, tell him he can come for visitation if he lets you know ahead of time so you can be sure to be home.

That is the most selfish thing I've ever heard! You would deprive your daughter of her dad and you would take a kid from your ex? I'm sorry, but there is more to think about than just making your life easy. You want to do the one thing to your ex that freaks you out the most. You are not in danger of losing custody.

Since there's is no preexisting custody/ visitation order, you can move out of state if you choose. He will then have to go to court to file for visitation. But you also have to consider the child in the middle. After you move, go to court in your county to establish a right to parentage custody/ visitation order. In issues of visitation the first one to move is usually the victor. But, please make an effort to be fair with regard to him having as much time as feasible, its whats best for the baby. Trust me

the only way you can get full custody or take him/her out of state is going though a lawyer and the father has to agree
