The wedding is in April, and I already have the deposit check or downpayment, whatever you want to call it. Can I cash that now?

Do you have a no refund policy? If so, then the deposit is yours (or part of it depending on your policy. So go ahead and cash it.

BUT! It is safe to not spend the money until after the wedding is complete and the clients recieve their photos. This is in case they complain about the photographs and demand a refund. In the unlikelyhood of that happening and they do have a valid reason to complain, it's best you have the money to refund.

It is a good thing to have a no refund policy because that will protect you from having the client pull out last minute. The whole point of a deposit is to reassure you that it is safe to reserve the date of the wedding. If the client were to pull out and you had no policy in place, you would have to refund their deposit and then kick yourself for turning down another paying client for that same day.

By all means, deposit it and hold the funds. I never move the money in my general account until the wedding pictures are delivered.

Now get to a lawyer and have him/her draw you up a legal contract for your state.

Are the funds a deposit? A retainer? A down payment? These are things you have to address before you get burned. If the couple backed out, most likely you would have to refund a deposit. A retainer is what they pay you to hold the date. Every state varies some in contract law, so in order to protect yourself and your clients, you really need a good contract.

Good luck to you and your new adventure. By all means, that's what the deposit if for. It's to cash now! It not only shows good faith on the part of the bride/groom, but it also give you some cash if you need it to get rolling. Just a heads-up...if it bounces, then you may want to re-think doing to the ceremony.

Yes cash it now-you will need the funds for rentals, film, an assistant fee and other costs.

I hope you put in the contract it was not refundable unless YOU cancel.

There are a number of books out there on wedding photo biz, go to the bookstore or your local photo shop and check them out. Buy the one that has a good section on your legal rights and responsibilities as well as tips on making successful photos.

yes just make sure you have the funds to refund it if you've promised a refund to the people. i personally wouldn't give a full refund because you just lost a day someone else could have booked. the closer to the date the less likely to book another wedding.

but yes definitely cash it you don't want to get screwed later when or if it bounces. remember these people are righting lots of checks to people and if you don't cash it you might screw them up later by cashing it.
