My husband was supposed to claim her for a better deduction on his. Can I file an amended form to take that deduction off mine, so that he can now claim her??

File an amended federal return (form 1040X) and remember to amend your state return as well.
The IRS will send a letter disallowing the exemption for both you and your husband if you don't file the amended return.
This will not cause an audit, the service will disallow the exemption and let you and your husband work out who claims the exemption.

You can file an amended return.You need to file an amended return asap. If you don't you wil be receiving a letter in the mail from the IRS for an audit.

BUT - If you filed electronically, he will not be able to file his taxes using her electronically as well. He will have to prepare his return and mail it in with the daughter listed. This should be done about 2-3 weeks after you correct your tax return by filing a 1040x.

Make sure to apologize.. it will delay his refund a few weeks and he may not be happy.
