okay can me and my husband claim my 1/2 sister if she lived with us for 8 months. the only problem is we have diffrent last names?? and what do they ask u for when doing this at h&r block?

Stacey ... Well, if you're going to a professional preparer to have your taxes done, they'd know best. Don't you think?

Usually the test of whether you can claim someone as a dependent is NOT how long they lived with you; it's the amount of support you provided. In other words, if you provided their food, shelter, and provided for their other needs and your contribution amounted to more than half of all their support expenses, you'd then be able to claim them PROVIDING no one else claims that person you supported.

I'm confident you'd need to provide their name and Social Security Number because the IRS is going to check. If they see that anyone else has claimed the same individual, that constitutes a conflict and one of the claims of support will be disallowed. Furthermore, although you may not be required to provide evidence of support when you file your tax return, you most definitely should have evidence in the form of receipts or other types of proof to verify your claim in case the IRS challenges this deduction.

TMA's answer has some merit, however, there are exceptions to the rule regarding the requirement to live with you for the entire year. See the section titled "Exception to time lived with you" on page 21 of the same link TMA and I provided (see below). The provisions of this exception may apply in your case.

If you supplied more than 1/2 of her living expenses and she doesn't claim herself. All that will be needed is her Social Security number and name. If she claims herself, you cannot claim her.
