China was united under dynasties (Ming, Chin, Han, etc...) then suffered under colonialism. When they gained independence after WWII, two groups struggled for power in a civil war...the Communists and the Nationalists. Of course the U.S. supported Nationalists and they were winning for a while... forcing the communists on "the long march", along the way they gained followers and spread their message, regrouping they drove the nationalists out...and they retreated to the island of Taiwan. So today...the island of Taiwan is seen by China (The peoples republic of China) as a province in rebellion. Taiwan sees itself as an independent country (The Republic of China). Most countries, including the United States, do not recognize the Republic of China but rather the island of Taiwan as a part of the Peoples Republic. The basic dispute is form of government.

The basic disputes between Taiwan and China are concerned with the sovereignty issue.
In other words, in regard to Taiwan's sovereignty, the Taiwanese say that it belongs to them, but the PRC Chinese say that it belongs to them.
Of course, "territorial sovereignty" is always held by a government. So in regard to the "territorial sovereignty" of Taiwan, what the Taiwanese are saying is that it belongs to their government, whereas the PRC Chinese say that it belongs to their government.
Unfortunately, there are no legal documents to add weight to the above mentioned assertions of the Taiwanese or the PRC Chinese. Hence, considering the provisions of the post-WWII San Francisco Peace Treaty (SFPT) of 1952, it seems most likely that the territorial sovereignty of Taiwan currently is being held by the United States Military Government in the form of a fiduciary relationship.
All military attacks against Taiwan in the Pacific war were conducted by United States military forces. Hence, Taiwan was "acquired" by the United States under the principle of conquest. The SFPT did not specify a final disposition of Taiwan, hence Taiwan remains under the administrative authority of the military government of the principal occupying power.
In order to understand the complexities of this type of arrangement, you have to have a rather in-depth knowledge of the laws of war, military jurisdiction under the US constitution, international treaty law, US insular law, and the functioning of United States Military Government (USMG) in overseas territories. The internet links provided below have some relevant commentary and analysis.

Taiwan is a democratic and free society, while the other is a closed one and has a totalitarian administrative system which cannot fluorish in the long run. In a democratic system, the dignity of people stays in good spirit perpetually although there may be ups and downs in the economy as time changes.

Political-Economic... (with religious undertones)
The Taiwanese fled mainland China and the COMMUNIST forces... Please kiddies go read the history of the Dictator Mao about "The Cultural Revolution" etc... the famines, the genocide, etc...
The Taiwanese created a free-democratic country... which gave root to a FLOURISHING economy.
Communist China treats them as a rogue province... they covet the MONEY and HATE their freedom.
Please remember that Communist China restricts searches on Google... search for "freedom" and you will be visited by officers of the political-police. Form a church in Communist China and prepare to go to JAIL.
