never married to x. son is now 12yrs old and I need to know how to protect the money I should be refunded aside from husband,even if we file jointly. The Irs is collecting a debt owed to the state in rears for hospital bills when the x was on medicaid/welfare. Husband was in jail at time of birth and never knew he owed this $ until the irs wanted to hold our refund

Do you have income? If so you can file an injured spouse form. The injured spouse form only works if the injured spouse (which is you) has income. Pretty much the IRS issues a refund to you based on your income. You can file it with your return, but since you've already filed your return, you'll have to mail it to the IRS Sometimes, by filing that form, it'll take weeks or even months for your refund to come.

I would suggest filing separately, unless the tax difference is extremely substantial. That way, there will be no way that you could get caught up in this.
If you have already filed, you will need to go through the innocent spouse route, which as Fool suggested may take considerable time.

Pawn one of your CDs and pay the 4$ for him. Surely you missprinted. You meant 4 thousand or forty thousand right?
