Assuming that I thought he was trying to pick up my girlfriend, I would take the drink and then go over and pretend like I was interested in him. Hopefully the gay-dar would go off and he'd get mighty uncomfortable.

Laugh at him while the two of you share the drink! (assuming that you confirm with the waiter that HE didnt touch the drink)
If you are super thirsty,
flirt with him and get a few more!
Invite him to the table if is pockets are deep.
Make a game out of it and see how many drinks you can get out of him. Give him HER cellphone number and let her talk to him (pretending to be you) and let the fun happen again for a second night. Make a bet (loser buys dinner) that you can get 4 drinks out of him
Later that night when you are alone with your girlfriend, you can laugh and reaffirm why you dont date men (cuz they are sooooo stupid!).

drink it after all it's free and by the way if the bartender hands it to you then you are safe as far as the drink goes because the stranger hasn't touched it

Um, if you mean straight girlfriend, just tell him thanks. If you're interested, buy him a drink back start a convo. If it's your lover girlfriend, just tell him you're taken and thanks for the drink I guess.
