I have called the employer everyday for almost two weeks now. They keep saying by next week.. I know by law they have to have them sent out by Jan. 31 st . What can I do?

If I were you, I would give them a few more days before I get upset. But if you want to stir up some stuff, you can report them to the IRS at 1–800–829–1040, and they will contact your employer with a "Form 4598, Form W-2, 1098 or 1099 Not Received, Incorrect, or Lost."

If you have your last pay stub that has all your required information on it, you can file using that, you just have to inform IRS when you send in your return that you have not received your W-2. I would call the company one more time and tell them that they are suppose to be given to the employees no later than Jan 31 and that if they can't get it together you will report it to IRS, which you can do. Look in your tax book or go online to get an 800 number for IRS and call and report it. They are suppose to fine employers so much per form not sent out as required by law.

I was about to say the exact same thing the guy "CPA" above me said. So I guess i am just backing up my advice with his.

Surprisingly there is so much BAD info on here this time of year it amazes me.
I do taxes and i cannot count how many times I have been wrong.
It has nothing to do with your question, I know. Just making an observation...
