i am a realtor and my broker has not sent out our 1099's yet, who and how do i report her?

i am new to this, and should have added that last year we didnt get them until the middle of march....and i already did contact her and she was ust mean and rude on the phone,talked around the question on the phone.

To no one. An employer does not have to send out tax statements until 1-31-07. Today, it's 2-2-07. Rather than report her, why not call first and say you did not get your form?

Approach her about it first. The IRS will ask if you did anyhow. Then make note of her mailing address and go to the IRS office in most county seats. They have a form that is part of a mailer that goes to the address for the person owing you the form. That person must respond or pay a fine. If she perjures herself in responding, jail and/or a fine is possible.

This ought to get at least YOUR 1099 on its way though it may not help your fellow realtors. However, let's face facts: she may not be doing it out of sloth but out of making poor records add up and what she sends, if sent hurriedly to meet the form's deadline, might not be... accurate... enough to suit you. So check what you get against your own records as best and as carefully as you can.

Under those circumstances, you should absolutely go to the IRS immediately and let them know what happened last year when they ask you why you haven't waited very long. Also, many people save their papers in the envelopes they arrive in. If you did, and the envelope has a postmark date, take the envelope from last year with you. That should overcome any reluctance on their part to send the form right away. (Actually, they can't refuse, but they can make it obnoxious for you.)

Well if you wish to continue with your RE license with this person might back off some. However I am aware that your Broker should have mailed them out no later than 1-31 and if it makes you that much difference then you can report them to the IRS but I would go thru the people that prepare your taxes and see what they have to say.

First make one more attempt to contact your broker, and document what you are told. If you have no success, than contact your local IRS office, and enlist their aid.
