You can file a return without him. You would file Married Filing Separately. There will be some tax credits that aren't available to you with that filing status, but if you choose to marry him & he still refuses to file a return, at least you will be protecting yourself.

True the IRS is not divorce court. But they aren't going to get involved here - if the check was reported lost or destroyed, they'd issue another one eventually - but the replacement would still be in both names, so it wouldn't help you any. You can't amend your return to single if you were married as of 12/31/2010, and it's too late to amend to married filing separately from a joint return, that would have had to be done by 4/15/11. You can hope, and argue, all you want, but yesterday's answers don't change. The responder who says that by law she is entitled to half is wrong, though. And what's the bit about deducting child support? That's not deductible, so if you did, you have another problem. Your only options are to either convince her to sign the check, which will likely involve some sort of split of the money, or to get a judge to rule she has to which isn't real likely to happen unless you give up something else in a divorce settlement. You reaped the benefits of a joint filing, and don't get to now say "yes, I did, but I also should get all the advantages of the joint filing" - the law doesn't work that way. Not what you want to hear I know, but that's how it is.

I would run in the opposite direction, but if you do marry him claim the filing status of married filing separate, so that you don't end up being liable for his tax debt.

If he doesn't file taxes, he will never qualify for a loan to purchase a home, I would not take a chance, unless he cleans up his act and files the returns from previous years. The IRS will catch up to him sooner than later.

Don't marry him. Is he just lazy or he must be hiding something else. It's not worth the crap the he will put you through. If thats the way he feels about taxes, he will probably surprise you with some other nasty stuff down the road to ruins. I'm sure there are lots of men that would be much better for you. Except me because I'm already married.

You could tell him to claim taxes on a .... nah, forget it, he's just not worth your trouble. If you love him, you'll have to cry a little and get over it.

Please do not marry that man! My dad did not file tax returns for years and the IRS finally caught up with him(and they will catch up to your "boo" too). Now he owes the IRS thousands of dollars that he probably will be paying for the rest of his life. You will never want to have anything joint with that man because whatever debt he has, will then also become yours. Good luck. Make a choice for your life that you won't REGRET!

A woman should be alerted to the fact that all may not be well with the man. He probably owes someone. Child Support?
A woman should find out why.

Just my opinion, but no. If he is hiding from taxes....there may be something else he's hiding from!

And if you were to marry him, to get any money back that you might be due, you would have to file as an injured spouse! It takes more time and a lot of headaches!

No, becauses he's a fool. Some day he's going to be hit with all kinds of fines & penalties even if he never would have owed them money. If your over 18 and make any kind of income, you HAVE to file.

If you know he should be filing a tax return and isn't then don't marry him. Not because of this one incident but because it may indicate he does other things you (seem to) find wrong.

I'd strongly advise against it!

If you're OK with the constant threat of your husband being arrested, or worse yet being arrested yourself since they'll look at YOU too once you're married and if you're OK with the constant threat of losing your home to the IRS, then go for it. Otherwise, I'd say that it's time to cut and run.
