i moved out of my moms house to live with my dad and she got mad about it of course and started a bunch of stuff...for example she told my dad that if he let me hang out with my best friend she would call the cops because he is 19 and im 16. we arent dating or having sex or doing drugs or anything we simply hang out just to get out of the house and stuff. plus he has a girlfriend anyways. can she press charges on him for being around me just because he is 19 and im 16?

No parent has the right to pick out our friends. If there is no sexual interference going on then nothing can be done legally. And trust me, if the cops realize that your Mom is just doing this out of spite, they will charge her with Public Mischief and let her spend a couple of days in jail.

If you both are friends and nothing sexual is happening between the two of you then no, she can't. That is my understanding on it all though. If you both were having sex, even if it's consentual, then yes she could press charges on him since you are a minor. It sounds like to me, that she is just trying to stir up a fight since you went to live with your dad and she is mad about it. Not only is it hurting you and your moms relationship but it will drive you farther away from her. I am sure it's hard on you and your dad as well knowing that she is doing this stuff. I really think, in my opinion, she needs some kind of help. Have you ever tried sitting down and talking to your mom or dad about this situation and telling them how you feel about it? Maybe your mom doesn't realize that by doing this she is hurting you and making really not want to live with her because she is doing this. Tell her that it is hurting you and how you feel. Maybe she will stop. I would really tell your mom the reasons why you moved to live with your dad, maybe she doesn't know and she is doing these things out of anger because she can't or doesn't understand why you moved.

Sweetheart, no she can't. Think about it. What charges will be filed against your friend if she called the cops? He isn't putting you in danger, you aren't having sex with him, so there is nothing the police will do. Of course if your mom calls the police the police will come. But most likely they wont do anything. Also it depends on what state you are from. I know in California your not a adult until you are 18 but in NY your adult when you are 16. But thats only when you are having sexual relations with a guy who is older than you.

No she can't, however, if she "pushed" the issue and made you look bad enough she COULD go to the juvenile division of the local court and attempt what's known in some jurisdictions as "Chins" or Child in Need of Supervision.

I truely believe you mom is just being overprotective and you should sit down with her and discuss the issue without yelling or being disruptive and rude.

Be the adult and show her you are more mature than what she's giving you credit for!

In the United States, individuals do NOT "press charges" or "file charges." That is the function of prosecuting attorneys. All your mother could do is go to the police and tell them she thinks a crime is being committed. If the police agree, they could make an arrest. If a prosecutor agreed, he could file charges. If there is no evidence that either of you is doing anything illegal, it is doubtful that the police would arrest anybody or that a prosecutor would charge anybody.

no but she can start a lot of trouble for him by telling the police that you 2 are having sex. then they will be hunting the both of you down for answers. let your dad know what is going on and let him meet your friend and actually talk to him. at least if your dad can vouch for him the cops wont arrest him.

Your a minor! You can't hang around with adults! With the right cops behind your mom, they can come up with a charge.

She can always file charges, the odds of them going anywhere if you really are not doing anything is nill and if she is really a pain that way, the 19 yr old can sue her for slander and malicious persecution.

No she cannot but if there has been anything that went on that you are not telling anyone then yes. Who has custody? If she does then she can file a restraint to keep him away. So I am not saying you are but IF you are lying then stop.
