It depends if you itemize your deductions or not. You typically need to be a homeowner to this. Example - If you owed $200 on your 2004 return assuming you paid it on April 15, 2005 you if you itemized you would be able to deduct the $200 on you 2005 tax return schedule A state and local taxes. A lot of the software programs would assume that you made that $200 payment in 2005. If the garnishment's started in 2006 for that 2004 tax that may have been taken on the 2005 return. The technically correct way to handle it would be to amend the 2005 return removing the $200 and deducting it on 2006 return assuming the garnishments totalled $200. In the example if you didn't itemize in 2005 and you are able to itemize in 2006 you would be able to deduct the garnishments in 2006 on you schedule A.
