I am in the process of selling a car to my sister. She was to make timely monthly payments for one year. Now she is three months behind and is refusing to pay the money. This was a verbal agreement between us and I do not have a contract. The title however is still in my name as the lein-holder. Can I legally have the car repoed?

No contract; you hold title. Report it stolen and go get it unless she is on the registration. THen you will need an atty.

Since it is a civil matter, you can't report the car stolen, esp. if she was making payments. As soon and she made the first payment it became a civil matter and if you want your money or the car back, you have to either take it or sue her in civil court. Good luck!

All repos are civil matters not criminal matters. Look for a lawyer dealing with civil law to get advice.
