As a married couple, you can file either jointly or separately. Even if you are separated, you can do this and you'll normally pay less tax that way.

However, if your estranged husband filed a joint return without your consent you should just file a proper separate paper return. This will trigger an investigation by the IRS. You'll just need to tell the IRS that you're separated and never authorzed your husband to file that joint return. He'll have to deal with them for filing a fraudulent return and you'll be in the clear.

How did the husband get his wife's information? And are you saying he filed a joint return but without your knowledge? That would be fraud - both spouses must sign a joint return.

If the wife files, the IRS will catch the dual filing and contact both people to ask what's going on. Then the person who filed a joint return without their spouses signature will be in trouble.
