It doesn't make sense that soccer moms and the like get to use the carpool lane. If you are riding in a car and you are not a lisensed driver than you really aren't helping to alleviate congestion.

I see where you are going on this, but what about all the people with no drivers license because they can car pool?

I think what you are going for is that passengers, to count for using the HOV lane (Car pool lane) should be or legal age to drive.
Lets get back to the soccer mom. She has a van full of the neighborhood kids and in the HOV lane. What if each parent were to drive their kid to practice? So by her carpooling all the kids at once she is helping to alleviate congestion.

I live in Germany and there are no HOV lanes here. Everytime I am in the USA on vacation or official travel, I see 70 percent of the people, flying down the HOV lane, traveling alone. Heck in Atlanta I even saw a few tractor trailer trucks get sick of traffic and chance it.

So it's not the age, but the number of passengers that needs to be better controlled.
