by Jan 31st you have not received your W2, call the employer and ask them if they have been sent. If by Feb 15th you have not received it, call the Internal Revenue Service at 1-800-829-1040 and file a W2 complaint. They wil take a report and send you a form that you can use as a subsitute, you will need your last paycheck stub when you call, along with the name, address and phone# of the employer and what dates you worked for them

Whether or not an employer goes "belly up" , that employer is still responsible for preparing a proper W2 for every employee prior to the collapse of the business. If you don't receive said document, you are within your rights to contact the company's attorneys and demand it be provided immediately. If they fail, you turn 'em in to your county or state attorney general's office - that phone number is in your telephone directory. The AG's office is responsible for enforcing employment law and will keep you informed. You should also ask whether or not you should contact a lawyer on your own.

Just because your employer bought the farm, doesn't mean that you shouldn't still receive your W-2. I don't believe that it's available online (thank goodness!!).
If worse comes to worse, you're going to have to go back in your pay stubs and figure out your income for the year.
I once had an employer who refused to send my W-2 to me, so I had to do that. Call a tax specialist first before doing anything.
