Do you have paycheck stubs showing your gross earnings and taxes withheld? The employers are required to mail W-2s by Jan 31st
by Jan 31st you have not received your W2, call the employer and ask them if they have been sent. If by Feb 15th you have not received it, call the Internal Revenue Service at 1-800-829-1040 and file a W2 complaint. They wil take a report and send you a form that you can use as a subsitute, you will need your last paycheck stub when you call, along with the name, address and phone# of the employer and what dates you worked for them The Internal Revenue Service will advise you what to do to file your return and what steps to take in reporting your employer of not filing the taxes he withheld

Really, this question needs more clarification. If your pay each pay period in 2006, showed deductions for Federal Withholding, State Withholding, Medicare, and Social Security (or any of these combinations, but he didn't actually pay them in, you have been de-frauded. It would be quite strange for the IRS to be able to indicate already that your w-2 is not matching their records this early in the tax season...If they have and this is the case you need to contact the IRS fraud dept, The Attorney General of your State, and file a police report. The worst news is that you as a tax payer is responsible to pay all of that in.

I had an employer withhold taxes and later I found out that they did not pay my withholdings to the government. If you have your paycheck stubs, you'll need to go to a tax accountant to help you file.
They'll need to file special forms. The employer should be liable.
I hear Block has a trax advisor line if you buy one of their online products.

you don't have a 1099 because you didn't make enough for him to issue you one and you didn't get W-2 because you were not an employee you could show him your tax return or you could get a free tax transcript, form 4506 T, from IRS to show him and no, IRS does not have a copy of a non existent 1099(or W-2)
