There is no filing status "divorced". Once your divorce is final, you are single. On your tax return, you use the status that applies on December 31 of the year you are filing. If you divorced by 12/31/06, your status for 2006 is single. If you divorced 1/1/07, your status for 2006 is married (filing jointly or filing separately). If you have one or more children, the situation is a little more complicated.

The year of the divorce is when you start filing single or head of household (If you have kids, and your ex signed a waiver to claim them as dependents.)

I myself would file divorced so the IRS has a record as to when you became divorced. Should any future problems exist on your or his tax returns.
