My cousin is married to a man from mexico who recntly entered the United States not to legally, how does he become a citizen?

He already is, he just doesn't know it , contact the immigration dept.

NOTE TO ALL WHO DON'T REALLY KNOW: When a foreign national marries a US citizen they do NOT I repeat NOT become instant legal permanent residents, let alone citizens.

First, if he is in the US illegally he must leave immediately - before the ICE finds him. Once he is caught the possibility of him EVER returning will be remote in the extreme.

Then your cousin must file for a K-3 visa that will permit him to return to the USA legally. For that you will need:

USCIS form I-129F

A passport valid for travel to the United States and with a validity date at least six months beyond the applicant's intended period of stay in the United States.

Birth certificate

Divorce or death certificate of any previous spouse for both the applicant and the petitioner

Police certificate from all places lived since age 16

Medical examination (vaccinations are optional)

Evidence of financial support (Form I-134, Affidavit of Support may be requested.)

Two Nonimmigrant Visa Applications, Form DS-156 (A Form DS-156, prepared in duplicate.)

Two nonimmigrant visa photos (each two inches 50 X 50 mm square, showing full face, against a light background)

Marriage certificate.

The consular officer may ask for additional information according to the circumstances of the case. Documents in foreign languages must be translated.

Take clear, legible photocopies of civil documents, such as birth and marriage certificates, to the interview. Original documents can then be returned to you.

NOTE: If he has any current legal immigration status in the US, they can skip all of the above and he doesn't have to leave.

Either way, after arriving in the USA, your cousin the US citizen must then file:

Form I-130 Petition for an alien relative
Form G325B Biographic information
Form I-485 Application to Register Permanent Residence or to Adjust Status
Form I-864, Affidavit of Support
Form I-131 Application for Travel Document
Form I-765 Application for Employment Authorization

Last but not least: very large amounts of cash; each application comes with a non-refundable processing fee ranging from US$180 to US$425. Figure US$1000 minimum - more if you get an immigration attorney involved (US$2000 to US$5000).

I am married to an illegal Mexican myself. He does not become a citizen since you are married. You have to apply at the immigration office in your area, and when you apply, write a letter stating why he needs to be here while working on the whole paper thing, or they will send him back until he is approved. I think the correct form to file is the I-129 along with the biographic info on both you and him, and last time I knew it costed $195.00 to file, but that is only the beginning. I would suggest having an immigration lawyer do it for you, that way everything is done correctly and sometimes it can make things move along faster. Good Luck and I hope I was of help to you.

If you marry someone from another country then you become a citizen of that country. At least that's what I thought. All you would have to do is show some papers that you're married, it shouldn't be that hard.
