we are not devoirced nor legally seperated. I have 3 dependants and had 2 for six months the other still with me. Although he claimed all 3 are with him.

You cannot claim the same kids twice if you are divorced and saying the kids are your dependents. The new laws say that only one parent may claim head of household and the kids as dependents (if you have two kids, one can claim one and the other parent can claim the other but it's a problem if you have an odd number of children).

Use School records, Dr records, a copy of your lease showing that the childs address of record is your address, A letter from your family Priest or Pastor. these are just a few things you can use to prove that you are entitled to claim your dependants

File a paper return, you will get a letter from the IRS requesting this information, respond to the notice as soon as possible

You have to stop by to the nearest IRS office and prove to them that you are entitled to those dependents.
Before that talk to your wife and in accordance with her you can use the depeendants.

In my case when we got divorced the kids dependent status was entered into the court order. The judge put it in there that I was entitled to carry them. My ex has asked to carry one... I just ignore him and file early. Let him try it, he will lose in the end. Of course, he is an idiot and lost everything anyway. :)

I'm assuming your divorced. Your divorce papers should spell out who gets the tax deductions as dependents for your tax return purposes.

you file your return by mail. the IRS will flag it. and your ex spouse, because the SS# will be used twice. they will ask you and him to prove that the credit was due to them. they will investigate. whoever was entitled to the refund gets to keep it. the one that was not has to pay back taxes, penalty's and interest. be absolutely sure that it is due to you, or the IRS will be knocking on your door.

If you have custody of the children and they live in your household you can show school records that will have their main residence listed as your home. As for getting it changed, good luck. Also,is she paying you child support. That alone would show custody and where they live.
