My son was born in March 06. This year my x-boyfriend made 19,000, and I made 38,000. My x-boyfriend's family told us that my boyfriend should claim our son because he would get more money back. I disagree. I had read that the person with the higher income should claim the baby. Also, I rent an apartment, could I claim head of household and get more money back? What do I do if my X claims my son? I pay for everything and my son lives with me.

If your son lives with you, YOU get the exemption. It doesn't matter who made more money, the custodial parent gets the exemption.

You also qualify to file as Head of Household.

If your ex b/f tries to claim your son, the IRS will contact both of you and sort out who it legally entitled to the exemption. That will be you. If you try to e-file and your return is rejected because your ex already filed and claimed him, just file a paper return. This will trigger the IRS investigation although it may delay your refund a while. When it's settled, you will get the exemption and your ex will get a bill from the IRS.

Get a copy of IRS Pub 501 from the IRS website. It explains it all.

You are the custodial parent, and have the right to the exemption. And yes, file as head of household.

The people who are saying that your ex-bf would get more money if he claimed him are probably thinking that he could then get an earned income credit. They're wrong. Even if you signed form 8332 allowing your ex to claim your son instead of you, your son wouldn't qualify your ex for the EIC.

The person that the child lived with 6 months or more gets to claim the child. If the child lives with you then you claim him. You can give him permission to claim your son, but if he lives with you, you need the refund to take care of the child and should claim him yourself. If the grandparents love this child they will not take money from the child, they will let you claim him.

if he lived with you you claim him if he lived with him then he claims him irs.gov free # to call for help.. help llllhelp help help me..
