It is illegal in many state to live together and not be married, the law is just not enforced, until the govt thinks you want something from them. Some people called me nuts I call the IRS and they said (Karen S. # 5909319) as long as it is not illegal to cohabitate together in GA (it is in FL) I could be a qualifying dependent. You are correct. If it's illegal to cohabit, even if the law isn't enforced, then he would not be able to claim you. But if there's no law on the books making cohabiting illegal, AND you lived with him all year, AND your gross income was under $3300 for the year, AND he provided over half of your support for the year, and a couple other requirements that you probably meet, then yes he can claim you. You'd be considered a qualifying relative. He couldn't claim head of household filing status though.

Well, the only thing is that in order for someone to be a dependent, they must be closely related, or placed in the home by a State or Federal Agency.......
